The following Terms of Use (“Terms”) should help you understand how you may use the services provided by PollPool (“Services”) and which terms apply to the services offered on the website (“Platform”). By opening an account with PollPool you signal your agreement to the Terms.
1.1 Data Privacy. Our Services require you to share data (such as your personal data and your opinion) with PollPool and other users, and in turn require third parties to share their data with you (such as their personal data and opinions). We will refer to this as your “Content”. It is of our highest importance that by entrusting us with your Content, we treat your data as your fiduciary as defined in our Privacy Policy. This implies as well that PollPool may use your Content adhering to these policies.
1.2 Content Confidentiality. PollPool will treat your Content as confidential information and will only use it in accordance with these Terms and our Privacy Policy.
2.1 Payment for Credits. By purchasing credits, you agree to the pricing and payment terms presented to you for that service. Payments are non-refundable, except as provided in these Terms or when required by law.
2.2 Price Changes. PollPool may change the price charged for Credits at any time and without prior notice to its users.
3.1 User Eligibilty. You are only eligible to use the Services if you have the power to form a contract with PollPool. The Services offered by PollPool are not intended for use by individuals less than 15 years old. If you do not meet these requirements, you are not allowed to form a contract with PollPool and use the Services. Accounts may only be used by one individual per account and may not be shared.
3.2 Password Safety. You are responsible to keep your password safe and to not disclose it with others. Any activity in your account that can be executed by the user is your responsibility. You can reset your password anytime should you notify an abuse of your account.
3.3 Profile Information. You must keep your contact details and profile information up to date and accurate. The Platform relies on the profile information entered by you, and Services can only be offered to you in a reliable manner if your profile information is correct.
3.4 Account Inactivity. We may delete your account and all of your content if we do not record any activity (such as a log-in event) for more than 8 weeks. Prior to removing your account we will send you an email to notify you about the upcoming termination.
3.5 Account Termination. If we notice any irregular activity from your account, which does not comply with these Terms, causes legal liability to us or disrupts our Services, we may suspend our Services to you. We will always try to notify you prior to imposing any sanctions on your account.
4.1 Content Ownership. You remain owner of all of your intellectual property rights in your Content. To enable us to provide our Services, you grant PollPool the worldwide, royalty free license to use and distribute your Content as necessary, while adhering to our Privacy Policy.
4.2 Content Liability. The Services provided require and display content that is not owned or generated by PollPool. Accordingly, the full liability and responsibility for the Content lies with the user who publishes it. You are required to ensure that you have all necessary rights and permissions to share your Content when using our Services. There may be content that includes links to websites of third parties. PollPool does not review and is not liable for content displayed on such third party websites. If you notice any unlawful content on the Platform, we need you to signal it by using the “Flag” function.
4.3 Content Review. By using our Services, you agree to adhere to our Survey Content Policy. To ensure compliance with this policy, PollPool may be required to review Content submitted to the Platform for Term violations or illegal content. This may be Content flagged by users or selected by PollPool on a random basis. We may ask you to modify your Content and ultimately may prevent access to, delete or refuse to display Content we deem as violation of the Terms and our Survey Content Policy.
5.1 You must comply with our Survey Content Policy and the following requirements when using the Services:
(a) You are required at all times to use our Services only as permitted by applicable law.
(b) You are prohibited from interfering with our operations, or accessing our Services through ways other than those provided.
(c) You are prohibited from circumventing any restrictions that PollPool may impose on your account.
(d) Unless authorized by PollPool, you are prohibited from testing the vulnerability or capacity of our system.
(e) You are prohibited from transmitting any malicious software or links to such software through our network.
(f) You are prohibited from reselling our Services or components thereof (such as Credits).
6.1 PollPool may at any time change or amend these Terms, update the Platform as well as change and improve the Services. You will be notified in case changes occur. For certain changes, applicable law may require PollPool to obtain your consent or to provide you with sufficient advance notice of them. If you do not agree to the changes, you may be required to stop using our Services.
7.1 Contracting Entity. Unless specified otherwise, you are contracting with and the Services are provided by Abel & Burkart GbR. References to “PollPool”, “we”, “us” and “our” are references to Abel & Burkart GbR., located at Baldhamerstrasse 54, 85591 Vaterstetten, Germany.
7.2 Governing Law. These Terms aregoverned by the by the laws of the Federal Republic of Germany.
